ACLU suing police over Exodus lyrics arrest

Posted by on May 5, 2015

It was last September when 31 year old James Evans was arrested for posting Exodus lyrics online. Those lyrics, from “Class Dismissed (A Hate Primer),” caused quite a stir in Muhlenberg County, as “multiple agencies received calls concerned about the post,” eventually leading to his arrest.

Now, the ACLU is filing a federal lawsuit against the county and the police officer Michael A Drake. Said ACLU of Kentucky Cooperating Attorney Brenda Popplewell:

“This case is not only about Mr. Evans’ right to engage in non-threatening speech online, but also his right to be free from unlawful police tactics in securing his arrest and prosecution for a crime he did not commit.”

The case against Evans was eventually dropped, though he still spent several days in jail for posting song lyrics on Facebook.
